Cancellation of the accommodation contract
Up to three months before the agreed arrival date of the guest at the latest, the accommodation contract can be cancelled without payment of a cancellation fee by both contracting parties by means of a unilateral declaration. The cancellation notice must be in the hands of the contracting party no later than three months before the agreed date of arrival of the guest.
The accommodation contract can be cancelled by both contracting parties by unilateral declaration at the latest one month before the agreed day of arrival of the guest, however, a cancellation fee in the amount of the room rate of 40% is to be paid. The cancellation declaration must be in the hands of the contracting party no later than one month before the agreed arrival date of the guest.
The accommodation provider has the right to withdraw from the contract in case the guest does not show up by 6 p.m. of the agreed arrival day, unless a later arrival time has been agreed.
If the Guest has paid a deposit, the room(s) shall remain reserved until 12 noon of the following day at the latest.
Even if the guest does not make use of the ordered room(s) or the pension service, he/she shall be obliged to pay the accommodation provider the agreed remuneration. However, the accommodation provider must deduct what he saves as a result of not using his service offer or what he has received by renting the ordered rooms to other parties. Up to 3 months before cancellation no cancellation fees are due, up to 1 month before the arrival date 40%, up to 1 week before the arrival date 70% and in the last week before the arrival date 90% of the total arrangement price.
It is incumbent on the accommodation provider to make every effort to let the rooms not used to someone else in accordance with the circumstances (§ 1107 ABGB).
